Parents Against Vaping Joins Federal Lawsuit to Hold FDA Accountable

 
 
 

On July 14, 2026 Parents Against Vaping joined a federal lawsuit against the FDA with a bipartisan group of public health organizations. The lawsuit challenges the FDA's new policy, which allows unauthorized e-cigarettes and nicotine pouches to stay on the market for an unknown amount of time. This includes flavored products that the FDA has repeatedly said pose a serious risk to young people.

This policy not only violates federal law but threatens to undo the hard-fought progress we and our partners have made in reducing youth use of harmful tobacco products. 

As parents, we cannot stand by as the federal agency charged with protecting the public health of America allows the predatory tobacco industry to create a next generation of lifetime customers. We are particularly proud of our co-plaintiff Jane Doe, one of Parents Against Vaping’s volunteers, who has joined the lawsuit to fight on behalf of her teenage sons who are addicted to flavored nicotine vapes. Jane Doe and her kids represent millions of families whose lives have been upended by the industry’s promotion of kid-friendly flavored nicotine. 

Together, along with our co-plaintiffs, we seek to hold FDA accountable for its failure to follow the law-and its failure to safeguard the health of our country’s young people.
